(a) The Puppy is in good health and free from any disease at the time of sale as far as can be reasonably determined by the Seller. Seller is not responsible if landlord, spouse, current pet, or any other individual or animal disapprove of the Puppy. If the Puppy is found to have parasites such as giardia or coccidia after a wellness physical exam is performed by a licensed veterinarian within 3 days of the Effective Date, then the first round of deworming and/or medication for this ailment will be reimbursed to Buyer by Seller. Giardia and coccidia are common puppy ailments that are easily treated, considered puppy maintenance, and are the responsibility of Buyer.
Buyer is provided a limited 15-day warranty against diagnosed viruses and limited illnesses. Within 15 days following the Effective Date , if a veterinarian diagnoses the Puppy with a virus listed below, then reasonable diagnostics and treatment related to the virus will be covered up to 100% of the Purchase Price of the Puppy. Buyer must notify Seller within 24 hours of the diagnosis being made. Seller reserves the right to require a second opinion to confirm or deny the virus by the veterinarian of Seller’s choice. Viruses/illnesses covered by this 15-Day Limited Warranty are Parvovirus, Distemper, Hepatitis, Canine Influenza, Tracheobronchitis (kennel cough), and pneumonia. All claims must be submitted by Buyer to the insurance provided (KUSA 30-day insurance) before being submitted to Seller for reimbursement. Any out-of-pocket expense relating to this 15-Day Limited Warranty will be reimbursed by Seller after invoices and veterinarian notes have been submitted and verified. All claims must be submitted within 30 days of the Effective Date. Seller is not responsible for any claims not submitted within the 30-day period. Any bills and/or balances are considered Buyer’s responsibility and should be paid at the time of service.
(b) Two Year Hereditary and Congenital Warranty. Seller provides a two-year warranty against congenital and hereditary conditions. This Two Year Hereditary and Congenital Warranty extends from the date of birth of the Puppy, not the Effective Date. Buyer must notify Seller within 24 hours of the diagnosis being made. Seller reserves the right to require a second opinion by the veterinarian of Seller’s choice. Buyer understands if the Puppy purchased from Seller is diagnosed by a licensed veterinarian with a congenital or hereditary condition within one year of Puppy’s date of birth, Buyer is entitled to, at Seller’s discretion, either a puppy of equal or lesser value or a reimbursement to Buyer up to 100% of the Purchase Price. Buyer understands if the Puppy purchased from Seller is diagnosed by a licensed veterinarian with a congenital or hereditary condition within the second year of the Puppy’s birthdate, at Seller’s discretion, Buyer shall be entitled to a store credit equal to 50% of the Purchase Price towards a puppy of their choice. This Two Year Hereditary and Congenital Warranty does not apply in instances where hereditary or congenital condition could reasonably be corrected, improved, or prevented.
Warranty Exclusions. The 15-Day Limited and Two Year Hereditary and Congenital Warranties DO NOT cover the following conditions:
(a) The temperament of the Puppy, as bad temperament can be due to improper socialization, discipline, and or training; Breed, breed quality, conformation, size, weight, coat, color, markings, showing ability or breeding ability of the Puppy; DNA testing in connection with a claim or dispute of breed. Furthermore, DNA testing will not be accepted under any condition unless Buyer receives prior written approval from Seller.
(b) Any condition that may result from injury or neglect. Buyer’s failure to show proof of proper care including invoices to regular wellness exams, deworming, vaccinations, treatment for care recommended, etc. will be considered negligence and void all warranties set forth in this Agreement.
(c) The 15-Day Limited Warranty and Two Year Hereditary and Congenital Warranty shall be null and void unless a veterinarian examines the Puppy and provides a stool analysis within three days of Effective Date. Excluded days are Sunday and all Federal Holidays.
(d) Buyer’s existing pet(s) for parasites or viral illnesses that may have been contracted by the Puppy. The Puppy should be kept away from any animals at home for a minimum of 3-7 days unless otherwise advised by a licensed veterinarian. All health warranties provided will be null and void should the Puppy come in contact with another animal within the first 3-7 days or if the Puppy has been taken outside within the first 3-7 days without prior approval by a licensed veterinarian.
(e) Allergy testing or allergies to dog food, grains, grass, or environment and or any other condition.
(f) Cherry eye, hypoglycemia, cancer, low grade heart murmurs, hip issues, patella issues, spay/neutering, undescended testes, retained baby teeth, deafness, or any non-lifestyle changing cosmetic genetic abnormalities.
Buyers Warranty.
(a) Within 3 days of the Effective Date, Buyer shall take the Puppy to a licensed veterinarian for a wellness physical exam. A required stool analysis (evaluation for internal parasites) is required at Buyer’s expense.
(b) If something is wrong with the Puppy, Buyer must submit a claim with Seller’s Solutions Department via Seller's website .Buyer assumes all cost when Buyer takes the Puppy to the veterinarian or emergency vet. Seller has no obligation to pay any veterinarian bills. In the event Seller elects to reimburse Buyer for a veterinarian bill (at the sole discretion and election of Seller), Buyer acknowledges that reimbursement may take 6-9 months and may be made in separate installments. (c) Buyer acknowledges that a safe and suitable home will be provided for the Puppy. Buyer also acknowledges that purchasing the Puppy is a responsibility that entails maintaining the health of the Puppy. Frequent veterinarian visits, proper feeding of good nutrition, vitamin supplements, and the cost thereof should be expected. Buyer acknowledges the Puppy food (Health Extension) provided on the Effective Date cannot be switched to a different brand for at least 3 months after the Effective Date without a licensed veterinarian’s approval. Additionally, if a licensed veterinary prescribes prescription food and/or treats to the Puppy, Buyer acknowledges that Seller is not responsible for this cost. Buyer understands that veterinarian bills required to keep the Puppy healthy is a financial commitment and is the Buyer’s sole responsibility to pay at the time of service. Seller encourages Buyer to spay or neuter the Puppy.
(d) Buyer is required to contact Seller if Buyer is no longer able to keep the Puppy. Seller will attempt to help Buyer find another home for the Puppy. Buyer is not allowed to surrender the Puppy to a shelter or rescue without Seller attempting to find another home for the Puppy first. Buyer agrees that Buyer has researched the breed Buyer is purchasing and Buyer understands the common health problems and the environment and care Buyer must provide for the Puppy to ensure safety and health
